These Terms and Conditions apply to property-retrieval standby services requested from the Office of the Penn Township Constable. By submitting a request, the requester acknowledges and agrees to the following terms.
A property-retrieval standby provides a professional on-site presence while an individual retrieves personal property from a residence, business, or other location.
The service is intended to help maintain order. It is not legal representation, legal advice, a determination of property ownership, authorization to enter a property, or a guarantee that any particular item may be removed.
Submitting a request does not create an agreement, confirm an appointment, or guarantee that service will be provided.
Every request is subject to review based on availability, location, documentation, safety considerations, applicable legal authority, and the circumstances reported by the requester. Service is accepted only after confirmation from the Constable’s Office.
The requester must provide complete and accurate information, including:
The names and contact information of the involved parties
The property-retrieval location
An accurate description of the requested service
A list of the property expected to be retrieved
Copies of relevant court orders or written agreements
Notice of protection orders, known threats, weapons, confrontations, or other safety concerns
The requester is responsible for having any permission, court order, or other legal authority required to enter the location or retrieve the property.
The constable will not decide who owns disputed property and will not provide legal advice.
The service does not authorize forced entry, trespassing, removal of disputed items, violation of a court order, or any other unlawful conduct. Items may be left at the location when ownership or permission to remove them is disputed.
All participants must remain orderly and follow reasonable safety instructions.
The constable may postpone, refuse, suspend, or terminate the service if:
Conditions become unsafe or disorderly
A participant becomes threatening or uncooperative
Relevant information was withheld or misrepresented
Legal authority is unclear
Police, emergency, or additional assistance is required
Continuing the service may violate the law or a court order
No refund is guaranteed when service is terminated because of unsafe conditions, misconduct, inaccurate information, or circumstances caused by the requester or another participant.
Appointments are not confirmed until the requester receives direct confirmation from the Constable’s Office.
Arrival and completion times are estimates. Court duties, emergencies, traffic, weather, safety conditions, cooperation of the parties, and other circumstances may cause delays or prevent completion.
Applicable fees will be communicated before service is confirmed. Fees may include travel, mileage, standby time, additional personnel, extended service, document review, or other necessary expenses.
Unless otherwise agreed in writing, payment may be required before the appointment. Additional charges may apply if the service exceeds the time or scope originally requested.
Cancellation and rescheduling requests must be made as soon as possible.
Fees already incurred—including travel, preparation, administrative work, reserved time, or payment-processing charges—may be nonrefundable. A late cancellation, unsuccessful appointment, denial of access, or failure of another party to appear does not automatically entitle the requester to a refund.
The Constable’s Office does not guarantee that:
Entry will be permitted
Another party will cooperate
Any particular property will be located
Disputed property may be removed
The retrieval will be completed within a particular time
The requested service will produce a particular legal or practical result
To the extent permitted by law, the Constable’s Office is not responsible for losses, delays, property disputes, missing or damaged items, or unsuccessful retrievals resulting from inaccurate information, actions of the involved parties, unsafe conditions, denied access, court restrictions, emergencies, or circumstances outside the office’s reasonable control.
Nothing in these terms limits any right or responsibility that cannot legally be waived.
The requester agrees that the Constable’s Office may communicate by email, telephone, or text message using the contact information provided.
Electronic communications may include scheduling information, requests for documentation, invoices, payment instructions, and service updates. Standard carrier charges may apply.
Information submitted will be used to evaluate, schedule, bill, document, and perform the requested service and may be retained as part of the office’s business or official records.
Do not submit Social Security numbers, banking credentials, medical information, or unrelated confidential information unless specifically requested through an appropriate secure method.
The Office of the Penn Township Constable is not a full-service law-enforcement agency.
Do not use the request form to report an emergency, active disturbance, crime in progress, or immediate threat to safety. Call 911 when an immediate police, fire, or medical response is required.
These terms are governed by applicable Pennsylvania law. Any dispute concerning the requested service will be handled in an appropriate court or forum having jurisdiction in Pennsylvania.
By submitting a property-retrieval request, the requester confirms that they:
Have read and understood these Terms and Conditions
Believe the information submitted is accurate
Have disclosed known safety concerns
Understand that submission does not confirm service
Agree to pay applicable fees for accepted services
Consent to conducting the request and related communications electronically
